Quale coniuge in crisi o separato non ha mai inviato un sms o un uozzappino o una mail all’altro coniuge per evitare la seccatura di telefonargli o, ancora peggio, di incontrarlo? Nessuno sul globo terracqueo.
Allora è bene che sappia che dal 17 luglio la Cassazione ha riconosciuto l’efficacia di prova piena ai messaggini inviati tramite sms o whatsapp, e anche a mail (Cass. Civ., ordinanza 19155 depositata il 17.7.2019).
Ma che significa, in parole povere? Vediamo di capirlo tramite il caso analizzato dalla Corte Suprema.
Una madre separata aveva deciso di iscrivere il figlio al nido e lo aveva comunicato al padre tramite un sms. L’uomo aveva dato il proprio benestare rispondendole con un altro sms. Quando poi l’asilo nido aveva richiesto il pagamento della retta il padre si era rifiutato di pagarla, sostenendo che il consenso inizialmente dato all’ex moglie tramite sms non aveva alcun valore.
La signora aveva quindi posto la questione al vaglio della magistratura, che le aveva dato ragione sia in primo grado che in grado di appello. Il padre aveva quindi presentato ricorso in Cassazione sostenendo che i messaggini possono solo avere valore di mero indizio, non certo di prova piena. La Corte Suprema però gli ha dato torto.
Per la Cassazione, infatti, i messaggini e le mail contengono la rappresentazione di atti, fatti o dati giuridicamente rilevanti e formano prova piena dei fatti e delle cose rappresentate se il coniuge contro il quale sono prodotti non ne contesta la loro ‘fedeltà’.
Dunque, il messaggino o la mail inviati all’altro coniuge valgono eccome, a meno che chi li ha inviati non riesca a dimostrare in maniera circostanziata che non rispondono al vero (non è sufficiente cioè dire semplicemente “disconosco quel messaggino o quella mail”). Fermo restando il potere del Giudice di valutare la questione anche attraverso altri mezzi di prova.
Occhio quindi a tutto ciò che scrivete tramite cellulare o mail. E non mi riferisco solo a semplici autorizzazioni di spesa. Certe parole, infatti, rischiano di pesare in giudizio più di un macigno.
